Art. 10 of the Declaration of Rights, apart from the last sentence added by art. 39 of the Amendments, would permit the legislative delegation of the power of eminent domain made by St. 1952, c. 354, to the Massachusetts Turnpike Authority without specification in the statute of the lands to be taken. [718-719] The restrictions and limitations in the last sentence of art. 10 of the Declaration of Rights, added by art. 39 of the Amendments, apply only where the Legislature authorizes the taking of ""more land and property than are needed for the actual construction of"" a highway, and do not limit the power possessed by the Legislature before such amendment to delegate the right of eminent domain for the purposes of highways.
